Our physician seems to believe that if a patient is in active labor for more than 24 hours they can bill for prolonged delivery services ? Is this true or do they have to remain with the patient from start to finish ? Can we use a modifer 22 with the global delivery ? Please advise if any one can suggest an answer

There is no "magic" number of hours to the labor process and it depends on a number of factors such as if this is the first pregnancy, the patient's age, obesity, position of the fetus, etc. It is up to the provider to document prolonged attendance at the delivery in order to add the modifier -22, note simply note that the patient was in labor the X hours. Hospital staff may be the ones who are in constant attendance and checking in the the provider to report progress, but unless there is physician involvement at the bedside or on the unit that is solely directed to care for this patient, you will not have the documentation to support use of the modifier -22.
